Terms of Service
Effective from 28 September 2026.
1. Seller
The service "Srebrna Moc: Vitality 50+" (the "Service") is provided by Robert Soszyński, a natural person (the "Seller"). By using the Service, you enter into an agreement with the Seller.
2. Acceptance
By using the Service you accept these Terms. If you do not agree with them, do not use the Service. Only adults may use the paid part.
3. The Service
The Service is a virtual trainer for people over 50: training plans, chair-based workouts, educational materials, a protein calculator and a progress diary. Some content is free; full access requires a subscription (weekly, monthly or yearly). The materials are educational and do not replace medical or physiotherapy advice.
4. Account
You provide truthful information and keep your password confidential. You are responsible for actions taken from your account.
5. Prohibited actions
- using the Service unlawfully, committing fraud or sending spam,
- infringing copyright and other intellectual property rights,
- interfering with the Service's security (malware, scanning, automated content scraping),
- sharing your account with others, reselling or copying content.
6. Intellectual property
The Service, its content, training programmes, texts, graphics and marks belong to the Seller. You receive a limited, non-exclusive and non-transferable right to use the Service for your own personal use within the plan you purchased.
7. Payments and subscriptions
Our online reseller Paddle.com handles the order process. Paddle.com is the Merchant of Record for all our orders. Paddle handles all customer inquiries regarding payments and refunds.
Payments, billing, taxes, renewals, cancellations and refunds are governed by the Paddle Buyer Terms. The subscription renews automatically until cancelled. After cancellation, access continues until the end of the paid period. Changing your plan takes effect immediately, with a proportional adjustment.
8. Service availability
We make efforts to keep the Service running properly, but we do not guarantee uninterrupted or error-free operation. To the fullest extent permitted by law, we exclude implied warranties.
9. Liability
You exercise at your own risk — consult a doctor before starting training. The Seller's liability is limited to the amounts paid in the last 12 months and does not cover indirect damages (e.g. loss of data or profits). These limitations do not apply to damages caused intentionally, personal injury where exclusion is not permitted, or statutory consumer rights.
10. Suspension and termination
We may suspend or close access in case of a material breach of these Terms, non-payment, a security threat or fraud, or repeated violations. After account closure, your data is deleted in accordance with the Privacy Policy.
11. Final provisions
Polish law applies. Disputes are resolved by the competent common court; a consumer may also use out-of-court dispute resolution methods. We are not liable for failure to perform obligations due to force majeure. Refund rules are described in the Refund Policy.
